The Nahir Galarza Case was an Argentine judicial process, classified in the caso file as: "Galarza, Nahir Mariana s/homicide doubly aggravated",[1]​in which Nahir Mariana Galarza (born on September 11, 1998), was found guilty of the murder of Fernando Gabriel Pastorizzo (born on January 3, 1997), which occurred on December 29, 2017 in the city of Gualeguaychú, province of Entre Ríos, Argentina, where they both resided.[2]​ The case received widespread coverage and repercussions in both national and international media..[3][4][5]

Galarza was initially sentenced to life imprisonment for homicide, aggravated by the circumstance of having maintained a stable relationship. She is the youngest woman to have been sentenced to life imprisonment in Argentina.

Context

Nahir Galarza was born on September 11, 1998, daughter of Yamina Kroh and Marcelo Galarza, that who worked as a provincial police officer. At the time of the incident, Nahir was in her first year of Law at theUniversidad de Concepción del Uruguay (University of Concepción of Uruguay), and played field hockey, which greatly influenced the case, as it made her more aggressive, focusing on her attitude towards her boyfriend.[6]

At the age of 16, there was a kidnapping report after she went missing for a day as a minor, but it was later discovered that the supposed kidnapping was a hoax. [7]

Nahir Mariana Galarza and Fernando Gabriel Pastorizzo (born January 3, 1997), lived in Gualeguaychú (40 km west of the international border with Uruguay), which has a population of around 100,000 inhabitants.[8]​Around 2012, they started a relationship whose characteristics were one of the topics debated in the case, as the defense argued that they only had occasional encounters for sexual relations, while the prosecution claimed they were a couple, even though they did not live together. The latter was the thesis that the court found proven. In January 2018, investigators confirmed through text messages and some photographs of Pastorizzo with Galarza and her family on a trip to Brazil in the summer of 2016, which strengthened the hypothesis of a romantic relationship between them, besides showing that Galarza's family knew Pastorizzo, despite having declared after his death that the young man was a stranger.[9][10]

Another issue related to the case was the nature of their relationship, as some evidence (text messages, Twitter posts, testimonies, among others) indicated that it was marked by violence and interrupted by temporary separations and reconciliations.[11]​Nahir's family declared to the media that Nahir was the one receiving violence from Pastorizzo. Her mother, Yamina Kroh, told the media that the defense and the prosecution had opposing positions, as the former argued that the victim was the violent one and the latter claimed the violence came from the accused. However, the court ruled out that Nahir had suffered violence from Fernando.[12]​ The Superior Court of Justice of Entre Ríos stated that "Nahir Galarza's defense wanted to demonize the victim." [13][14]​ There were numerous comments, opinions, and conflicting statements on this point —some coming from family and friends of either of them— that were published in the media and on social networks.[15][16]

Murder

Fernando Pastorizzo was murdered in the early hours of Friday, December 29, 2017, on General Paz Street between Artigas and Pueyrredón, in the Tomás de Rocamora neighborhood of Gualeguaychú, receiving two gunshot wounds. The body was found on the ground next to his motorcycle, with no signs indicating it was a robbery. Shortly before he was killed, he was giving Galarza a ride, who then walked about 20 blocks to her house. After Pastorizzo's corpse was found in the morning, Nahir posted a photo of her and Fernando on her social media from her mobile phone with the caption:

"5 years together, fighting, coming and going but always with the same love. I love you forever, my angel. Nahir Galarza, December 2017."

The next morning, she admitted to her parents first and then to the authorities that she had committed the act. She said she had shot him with her father's service weapon, a 9 mm, which she had taken with her and then returned to where she had taken it without her father noticing either action. She stated that she first shot him in the back and then in the chest. [18][19][20]

In a video obtained by the police from a private security camera, a person with a very similar build to Galarza is seen walking at 5:22 AM (local time), just six blocks from where Pastorizzo's body was found.[21][22]​ For the prosecutor, the video was a key piece of evidence placing Galarza at the crime scene, although the accused's family denied that the person in the video was her. [23]

Galarza was charged by the prosecutor with "aggravated homicide by the bond" and was held in preventive detention, a condition she maintained until her conviction.[24]

Sentence

Nahir Galarza was sentenced to life imprisonment on July 3, 2018, after being found guilty of aggravated homicide, which applies to someone who kills a person with whom they have or have had a romantic relationship, whether or not they cohabited. The court dismissed the aggravating factors of using a firearm and premeditation that the prosecution and the plaintiffs had requested. This sentence means she must serve at least 35 years in prison.[1][25]

To date, Galarza is the youngest woman to receive a life sentence in Argentina (she was 19 years, 7 months, and 21 days old), although she is not the youngest woman at the time of committing the punishable act for which she received the sentence.

In 2016, also in the province of Entre Ríos, Paula Araceli Benítez received the same sentence for the homicide of her mother committed when she was 18 years old in April 2015, but at the time of the sentencing, she was just a few days older than Galarza (she was 19 years, 8 months, and 1 day)..[26]

The sentence was based on testimonial and documentary evidence (photographs, text messages, and internet messages, etc.) to conclude that there was a romantic relationship and on forensic evidence to dismiss the possibility that the shootings were accidental (according to the expert, there was a 50% chance of the first shot being accidental, but the second shot was clearly intentional, from 50 centimeters away from the deceased). Finally, it considered that there was no evidence that Pastorizzo had exercised violence against his girlfriend, thus dismissing this mitigating factor argued by the defense.[25]

On September 4, 2018, it was announced that Galarza would be transferred to a regular women's prison, Unit 6 in Paraná, after surpassing the maximum period a prisoner can spend in a police station. She had spent eight months in the Juvenile and Women's Police Station. On September 10, the Entre Ríos Penitentiary Service carried out the transfer of Nahir Galarza to Unit No. 6 Concepción Arenal in Paraná. This is the only women's prison in the province of Entre Ríos, where Galarza shares a pavilion with nine other inmates..[27]

In August 2019, the Concordia Penal Cassation Chamber rejected the appeal made by Nahir's defense. Therefore, the life imprisonment sentence was confirmed. That same year, it was revealed that Galarza, among other prison activities, was studying psychology.[28][29]

In March 2020, the Supreme Court of Justice of Entre Ríos rejected the challenge to the life sentence imposed on Nahir Galarza. In total, Nahir Galarza's defense has made two appeals, both of which were rejected.[30]

In January 2022, Galarza changed her lawyer and, with the support of her mother Yanina Kroh, accused her father Marcelo Galarza, and the accusation was dismissed.[31][32][33][34]​ However, there is a restraining order preventing Marcelo Galarza from approaching his ex-wife Kroh and the penitentiary where his daughter resides.[35]

The national court is the last and only avenue of appeal for the defense to try to overturn the life sentence.[36]

The murder of Fernando Pastorizzo generated extensive coverage from national and some international media. It was featured in headlines of various newspapers, news radio programs, and television channels. The Galarza family hired a public relations agent just days after the incident, who provided the media with some photographs of the accused as a baby and as a child.[6][37]

The case also became a focal point of opinions on various social media platforms. Nahir's personal accounts were flooded with both supportive and hostile messages. Her Instagram account was closed after she was arrested, but twelve days later, on Wednesday, January 10, it was reactivated and within just twenty-four hours had gained over 30,000 followers. There were some changes, as she unfollowed three people and deleted two photos featuring the accused and the victim, and a day later, the profile was deleted. Following this, multiple accounts emerged with photos of Galarza taken by her followers..[38]

On January 2, 2018, a march of hundreds of people was held in front of the Gualeguaychú Courthouse with banners featuring a photo of the victim, Fernando Pastorizzo, demanding justice for the conditions of privilege in which the murderer, Nahir Galarza, was held.[39][40]

On January 3, 2018, the posthumous 21st birthday of Pastorizzo, friends and family posted messages and photographs on social media with reminders, calls for justice, and comments of condemnation against Galarza.[41][42]

On July 10, 2018, the group Todo preso es político (Every prisoner is politic) called for a demonstration in front of the House of Entre Ríos in Buenos Aires to demand Nahir Galarza's "immediate freedom," with slogans such as "Death to the men is not just a metaphor, fear will change sides." This group criticizes "heteropatriarchal violence" and "hegemonic feminism", and considered that "in the last six months, Nahir Galarza has suffered a genuine witch hunt led by the media, the judicial power, and the commonly referred to 'public opinion.'".[43]
